These Terms of Sale (these “Terms of Sale”) apply to your purchase of classified advertisement listings (“Seller Ads” and each, a “Seller Ad”) on the ConnEQtions.net website (together with any content, functionality, and services offered on or through the ConnEQtions.net website, the “Website”) that are offered through the horse listing and information service (the “Service”) offered by Candid Investments, LLC, an Oklahoma limited liability company (the “Company,” “we,” or “us”).
1. General Provisions.
A. By placing an order for any Seller Ad appearing through the Service, you accept and are bound by the terms and conditions in these Terms of Sale. Additionally, you agree to our Terms of Use (as amended from time to time, the “Terms of Use”), available at, and our Privacy Policy (as amended from time to time, our “Privacy Policy”), available at, and all other policies, site rules, and agreements referenced herein or therein, each of which are incorporated herein by reference. In the event of any conflict between these Terms of Sale and the Terms of Use, these Terms of Sale shall prevail. If you do not wish to be bound by these terms and conditions, you should not place an order for a Seller Ad through the Service.
B. Seller Ads are available only to sellers who want to list their horse(s) for sale. The Company and its affiliates reserve the right (but assume no obligation) to delete, move, or edit, without refund, any Seller Ad that come to our attention that we consider unacceptable or inappropriate, whether for legal or other reasons.
C. By using the Service or submitting an order for a Seller Ad, you represent that you are at least eighteen (18) years old, you are not offering horses for sale as a paid service to a seller or owner of a horse, and you are not acting as a broker or agent for a private seller that placed a Seller Ad through the Service. If you are accessing or using the Website on behalf of a business, by using the Service, you represent and warrant that you have authority to accept the Terms of Sale on behalf of that business, that such business agrees to these Terms of Sale, and that you and such business will use and access the Website and use the Service for a legitimate business purpose.
D. The Company reserves the right to deny use of its products and services, which includes the Website, to anyone who does not comply with these Terms of Sale or the Terms of Use, or who otherwise use such online and/or offline products or services, including the Website, in a manner we consider inappropriate.
E. We may revise and update these Terms of Sale from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all Seller Ads and use of the Service thereafter. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.
2. Using the Service.
A. When you offer a horse for sale through the Service, you must be prepared to sell that horse at the price at which, and the terms on which, you’ve listed it. You must have possession of the actual horse listed and the ability to transfer ownership and registration, if applicable.
B. To list a horse for sale through the Service, you are required to provide certain identifying and contact information. The information in your Seller Ad must accurately identify you and the method of contact must permit buyers to communicate directly with you. You may not include in your Seller Ad the name, telephone number or email address of any agent, broker or dealer.
C. You may not charge any potential buyer for information about any horse listed for sale on the Website, nor may you use the Website to promote, without our prior written permission, any other website, product or service. Any rights and obligations you maintain under these Terms of Sale to access and use the Service are personal to you. Consequently, you may not assign or delegate any such rights or obligations to any third party, which includes agents, brokers or dealers.
D. Ad(s) placed through the Service may not be used to advertise more than one (1) horse per Seller Ad purchased, regardless of the type of advertising package you select or the duration of its publication. For this reason, you cannot edit your horse’s description once you have purchased a listing. Always double-check this information before purchasing a listing. Listing fees are generally not refundable, so if you enter incorrect information, you will have to delete the listing and purchase a new one to create an accurate listing.
E. Responsibility for the information contained in your Seller Ad lies with you, the seller. You alone are responsible for material you post online, and for the content of all messages transmitted through the Service.
3. Quality Assurance.
A. Though we can’t monitor every advertisement that originates on or takes place through the Service, we may perform random quality assurance tests to confirm that sellers who offer horses for sale through the Service are prepared to sell the horses they advertise at the prices at which, and the terms on which, they advertise them.
B. Photos submitted as part of any Seller Ad placed through the Service must correspond to the actual horse being offering for sale. As part of our random quality assurance tests, if we encounter a photo that we believe does not accurately represent the actual horse you are offering for sale through the Service, we maintain the right to immediately remove such photo(s) and/or your corresponding Seller Ad.
C. By using the Service, you agree to cooperate with these random quality assurance tests. If our tests reveal, or we otherwise learn, that you are engaging in “bait and switch” or other unfair or deceptive practices, the Company and/or its affiliates reserve the right to deny you use of the Service.
D. In connection with our efforts to combat fraud, some Seller Ads may be screened before being posted publicly. This process may delay display of your Seller Ad for up to 72 hours from the time you submit your Seller Ad. If your Seller Ad does not appear on the Website after 72 hours, you may contact the Company via email to.
E. Although the Company cannot monitor all the Seller Ads processed through the Service, we reserve the right (but assume no obligation) to delete, move, or edit, without refund, any ads, postings or other electronic communications in our sole discretion.
F. By placing Seller Ads through the Service, you agree not to post or transmit any defamatory, abusive, obscene, threatening, misleading, or illegal material, or any other material that infringes on the rights of others or interferes with the ability of others to enjoy the Website or our affiliated products and services. The Company and our affiliates retain the right to deny access to anyone who we believe has violated these Terms of Sale, the Terms of Use, and/or our Privacy Statement.
4. Fees, Payments and Refunds; Premiums, Promotions and Free Services.
A. You agree that each order of a Seller Ad that you submit to the Company is an offer to buy, under these Terms of Sale, the Terms of Use, and all other applicable policies, site rules, and agreements referenced herein or therein, all products and services listed in your order. All orders must be accepted by the Company, or we will not be obligated to sell the products or services to you. We may choose not to accept orders at our sole discretion, even after we send you a confirmation with your order number and details of the products or services you have ordered.
B. By placing a Seller Ad through the Service, you agree to pay all fees and charges incurred at the rates in effect for the billing period covering the advertising package(s) you obtain, regardless of whether your horse sells as a result of the ad package(s) you purchase. All fees and charges will be applied against the form of payment you provide as part of the ad selection process and you agree to pay such fees and charges. You also agree to pay any applicable taxes relating to your use of the Service. At its sole discretion, the Company reserves the right at any time to offer the Service at a discount or to provide premiums and promotions as incentives.
C. When you list a horse for sale using any free advertising service that we may offer, you will be asked for information on the horse you are selling and on how you can be contacted by potential buyers. We may also ask you for other personally identifying information for security purposes. We may use this information to contact you about your Seller Ad, or for marketing and other promotional purposes, including offers of additional paid ad services.
D. You must use care when selecting your ad package and inputting information for your Seller Ad; Seller Ad fees are not refundable, even if you provide erroneous information or fail to sell your horse. Without limiting the generality of the foregoing, we cannot provide you a refund or credit if you change your mind about publishing your Seller Ad, its content or any enhancements you purchased in relation to your Seller Ad selection. You may incur an added charge if you wish to order enhancements to your initial order for your Seller Ad. You are not entitled to a refund or credit if you wish to change to a less expensive ad package. We cannot provide you a refund or credit if you made mistakes while submitting your Seller Ad information or if you fail to receive any inquiries or offers to purchase your horse through the use of the Service. No refund or credit will be issued if you sold your horse through other means.
E. While we will not provide you a refund or credit in cases where we have made mistakes in the connection with the publication of your Seller Ad(s), we will use reasonable efforts to correct any mistakes we might have made in placing your Seller Ad (i.e.: ads we reasonably determine are duplicative, or contain erroneous information); provided, that you contact the Company within the first 72 hours from the time we accept your order for a Seller Ad.
F. The Company uses Stripe, Inc. (“Stripe”) and its affiliates as the third-party service provider for payment services (e.g., card acceptance, merchant settlement, and related services). By submitting payment to the Company or submitting an order for a Seller Ad, you agree to be bound by Stripe’s Privacy Policy and its Terms of Service and hereby consent and authorize the Company and Stripe to share any information and payment instructions you provide to the minimum extent required to complete your transactions.
5. Added Value Services. When you list a horse for sale through the Service, we may obtain additional distribution for your Seller Ad through our relationships with other websites. Those providers may contact you about your ad on their website and may try to sell additional services to you, but you are not obligated or required to purchase any additional services and may be able to opt out of displaying your ad on their website.
